PLANNING CONTROLS
In preparing your development application you will need to take into consideration the following documents that set the policies for planning and development in Dungog Shire. These documents are available on Council's website www.dungog.nsw.gov.au or can be inspected at Council Offices in Dungog.

DUNGOG SHIRE LOCAL ENVIRONMENTAL PLAN 2006
The Local Environmental Plan (LEP) is the main planning document for the Shire. All land within the Shire is classified into land use zones, with these zones shown on a map which is on display at Council. If considering development, the first step is to check how your land is zoned. The LEP details the land uses and activities allowed in each zone and the factors that need to be assessed and addressed in developing within each zone. It also has specific provisions in relation to development of heritage items and within heritage zones, environmental protection, buildings and subdivisions, and tourism development in rural areas. The LEP also provides a list of definitions (for example, what is a 'commercial premise' and what is a 'shop'). Items of heritage value and heritage precincts are also listed in the LEP.

DUNGOG SHIRE DEVELOPMENT CONTROL PLAN No 1
The Shire-wide Development Control Plan 1 (DCP) supports the Local Environmental Plan No 1. It provides the design guidelines and design controls required to achieve the aims and objectives of the Local Environmental Plan. LOCAL AREA PLANS FOR MAJOR TOWNS AND VILLAGES
If you are proposing to develop on land surrounding Clarence Town or other villages that is zoned 9(a) Transition, you will need to consider the provisions of the Local Area Plan.
Local Area Plans establish a desired future character for land that is contained within the Transition areas.

SECTION 94 CONTRIBUTIONS PLAN
Where development generates additional demands on the Shire infrastructure, facilities, services and/or resources, a contribution under Section 94 of the Environmental Planing & Assessment Act may be applied. The amount of the contribution is detailed in Council's Section 94 Contribution Plan. (Note: you may also need to pay Section 64 headwater fees to contribute to the cost of providing reticulated water and the sewer system - check with Council).

Each year Council sets fees and charges for the services it provides in the Shire. All Council fees and charges relating to development and construction in the Shire are included in this schedule, which is available from Council's website.

STATE GOVERNMENT LEGISLATION
Some types of development will also need to take into consideration various State Government legislation. The 'Integrated Development' Information Sheet available from Council lists the different approvals required. In Dungog Shire, the most common State Government Planning Legislations that are applicable relate to Bushfires and to the clearing of native vegetation in non-urban areas.

BUSHFIRE - PLANNING FOR BUSHFIRE PROTECTION
To minimise the devastating impacts of bushfire, the NSW Government requires that development in bushfire prone areas meets specific requirements. Bushfire prone areas in Dungog Shire have been identified and are shown on the Bushfire Map, available at Council.
Before developing you need to check the bushfire risk classification of your land. If your land is in a bushfire prone area you may need to meet the requirements of the Planning for Bushfire regulations. This document is available from www.rfs.nsw.gov.au

NATIVE VEGETATION ACT AND REGULATIONS
You may need approval from the Hunter Central Rivers Catchment Management Authority to clear trees and other native vegetation in non-urban areas within the Shire.
Information on the clearing of native vegetation is available from www.hcr.cma.nsw.gov.au. You also need to consider the provisions of the Threatened Species Act
